Kanye West sued over 'illegal' use of samples on 'Twisted Fantasy'
Two tracks on the album - 'Who Will Survive In America?' and 'Lost in the World' - feature a sample from 'Hook and Sling, Part 1' by New Orleans pianist Eddie Bo.
Billboard reports that Bo's label TufAmerica has filed a complaint in federal court in Manhattan over the use of the samples.
They claim that West's label Roc-A-Fella and parent company Universal Music Group paid a license fee of $62,500 (38,670) for rights to use a portion of the song, but "failed and refused" to confirm licence agreements that accounted for other uses of the sample, including in the 'Lost in the World' video and the promo that accompanied 'Runaway'.
TufAmerica is now seeking an undisclosed amount of damages for copyright infringement. The label made headlines in May for suing the Beastie Boys for a similar copyright claim, just one day before founding Beastie Boy Adam Yauch died of cancer.
Kanye West and Jay-Z were sued last year for copyright infringement over the illegal use of a sample on the Watch the Throne album. The case was later settled out of co! urt.
My Beautiful Dark Twisted Fantasy was a huge critical and commercial success for West. It was named as 'Best Album' in numerous 2010 end-of-year polls, spent 32 weeks on the Billboard 200 and sold over 1m copies in the US alone.
